ALEXANDRIA, VIRGINIA: Client had prior DUI in another state, along with 7 other criminal convictions, received 4 new charges in Alexandria. DUI Drunk Driving charge (VA Code 18.2-266) with a BAC of .22 resulted in conviction for a regular first offense DWI charge with no penalty enhancement, nor language as to the BAC in the conviction – with just 15 days to serve and the standard first offender treatment. Reckless driving by Speed (VA Code 46.2-862) was reduced to Speeding 19 PMH over with a $75 fine. Obstruction of Justice by Threatening Law Enforcement Officer (Va Code 18.2-460) was DROPPED even though Client repeatedly threatened to kill the police officer who arrested him. Refusal to submit to breath / blood test (Va Code 18.2-268.3) charge was also DROPPED.

Fairfax, Virginia: Client was charged with class 1 misdemeanor DWI / DUI Drunk Driving (VA Code 18.2-266), Refusal to submit to a breath / blood test, and misdemeanor Reckless Driving by Speed 80/55. The Refusal and Reckless Driving charges were DROPPED and client walked away with a DUI plea with no active jail time and restricted license permitting her to travel to all the places that she requested on the application. (Together with the standard DUI disposition of ASAP classes, etc.)

All charges were DROPPED prior to commencement of a jury trial with a plea to one felony and one misdemeanor, significantly reducing client’s potential jail sentence.

Fairfax City, Virginia: Client was facing 3 criminal charges: misdemeanor DUI drunk driving (VA Code 18.2-266), misdemeanor refusal to take a breath / blood test, and misdemeanor driving in violation of restricted / revoked driver’s license. The evidence in this case overwhelmingly favored the government, as the client was recorded by the police officer’s video camera, which showed the defendant acting uncooperatively, intoxicated, and racist.
This was also the client’s second DUI/DWI offense within 5 years – which has a mandatory 20 day jail sentence under Virginia law. Client was facing up to 3 years in prison, and up to a $7,500 fine on all charges.
RESULT: Guilty plea to the DUI with the mandatory minimum jail sentence and no additional jail time, and the other two misdemeanors were DROPPED.
