ALEXANDRIA VIRGINIA: Felony Hit & Run Charge – Failure to Stop at Scene of Accident (VA Code § 46.2-894) was reduced to a misdemeanor charge with 30 days of modified work release in lieu of an incarcerated jail sentence, and a fine of $100. Related Driving on Suspended charge was dropped.

Fairfax, Virginia: Client was charged with class 1 misdemeanor DWI / DUI Drunk Driving (VA Code 18.2-266), Refusal to submit to a breath / blood test, and misdemeanor Reckless Driving by Speed 80/55. The Refusal and Reckless Driving charges were DROPPED and client walked away with a DUI plea with no active jail time and restricted license permitting her to travel to all the places that she requested on the application. (Together with the standard DUI disposition of ASAP classes, etc.)

ALEXANDRIA VIRGINIA | United States District Court for the Eastern District of Virginia in Alexandria: 5 out of 6 Federal criminal traffic charges were dropped, including Fleeing to Elude Police and Resisting Arrest with a plea to the drunk driving charge – 2nd DUI / DWI in 5 years. Instead of the Virginia standard 20 days mandatory minimum jail time, client walked away with just 10 days to serve and was permitted to serve this time on the weekends on his schedule. Instead of the mandatory minimum Virginia $500 fine for any 2nd DUI in 5 years, client walked away with only a $250 fine. Client was also given a restricted license right away.

Misdemeanor Driving on Suspended License DROPPED and Speeding Ticket REDUCED in Arlington VA
2011
Arlington, VA: Class 1 misdemeanor charge of Driving on a Suspended / Revoked License, (which carries up to a year in jail under VA Code 46.2-301) was DROPPED due to improper notice. Speeding ticket was REDUCED to a lower speed with only a $25 fine.
Client 1: Fairfax County, Virginia: First Offense – Misdemeanor Reckless Driving by Speed of 80 MPH in a 55 zone (VA Code 46.2-862) was REDUCED / AMENDED to a traffic ticket for speeding, at a REDUCED speed of 74 in a 55 zone, and only a $100 fine.
Client 2: Fairfax County, Virginia: Repeat Reckless Driving Offender – Misdemeanor Reckless Driving by Speed of 87 MPH in a 55 zone (VA Code 46.2-862) received only a $100 fine with NO suspension of his driver’s license and NO jail time.

Fairfax County, Virginia: Client’s 3rd class 1 misdemeanor DWI / DUI Drunk Driving (VA Code 18.2-266) charge with a BAC level of .14 – following a car accident – results in a conviction for a DUI charged as a first offense. Client received standard first offender treatment. Client’s fine was $250 and he has to attend ASAP classes. No active jail time.

CHARGES DROPPED: Class 1 Misdemeanor Driving on Suspended License Ticket in Alexandria VA

Alexandria, VA: Class 1 misdemeanor charge of Driving on a Suspended / Revoked License, (which carries up to a year in jail under VA Code 46.2-301) and related traffic ticket were both DROPPED.
Northern Virginia: Class 1 Misdemeanor Reckless Driving / Speeding (VA Code 46.2-862) and Class 1 Misdemeanor Driving on a Suspended Driver’s License were DROPPED with a plea to the DUI / DWI charge (VA Code 18.2-266) with no additional jail time than the mandatory minimum time of 5 days for a BAC above .15.

WHAT IS RECKLESS DRIVING IN VIRGINIA?
Reckless Driving is a misdemeanor criminal charge in Virginia. If your speed was either 20 miles over the speed limit, or if you were going at a speed over 80 miles per hour, then your “speeding ticket” is likely a Virginia Uniform Summons for Reckless Driving. And so, what looks like a regular speeding ticket may be much more than just a lot of points on your driving record. Reckless Driving is a Class 1 Misdemeanor under Virginia VA Code § 46.2-862 “Exceeding speed limit” – the same level of offense in Virginia as a DUI, assault, or larceny charge. That yellow ticket that you signed is actually an alternative version of an arrest for reckless driving. RECKLESS DRIVING ISN’T THE EVERYDAY SPEEDING TICKET. This charge frequently appears as “82-1-6″ on a Fairfax Driving Summons.

A repeat offender (with 12 prior felony and misdemeanor convictions) was charged with 8 total criminal offenses – felony endangerment / eluding police (VA Code 46.2-817), misdemeanor 2nd DUI in 5 years (VA Code 18.2-266), misdemeanor reckless driving (VA Code 46.2-852), misdemeanor driving on a suspended license after a DWI (VA Code 18.2-272), misdemeanor driving on a revoked license 3rd offense (VA Code 46.2-301), misdemeanor drinking while driving / open container of alcohol in vehicle (VA Code 18.2-323.1), refusal to take breath test (VA Code 18.2-268.3), and traffic offenses. All charges were DROPPED prior to commencement of a jury trial with a plea to one felony and one misdemeanor, significantly reducing client’s potential jail sentence.
